Eating or Taking Medications on Fast Days

This article examines halachic guidance for fasting, eating, drinking, and taking medication on rabbinic fast days and Yom Kippur, including pregnancy, illness, nursing, and shiurim.

Introduction1

Regarding eating or taking medication on a fast days, we do not address persons who require food, drink, or medication for life-threatening illnesses, as it is well known that anyone who has a life-threatening illness, or an illness which can possibly result in a fatality, is exempt from all prohibitions,2 even Yom Kippur prohibitions.3

Rather, we discuss the permissibility of eating or at least taking medication for persons who are ill, or pregnant, or nursing, or suffering from an ailment such as a headache or cold symptoms or are experiencing weakness as a result of the fast.

In Section A we discuss who may be exempt from fasting on the four fast days instituted by Chazal (Tisha B’Av, 17th of Tammuz, Tzom Gedalia, and the 10th of Teves) and Taanis Esther. For example, on Tisha B’Av are nursing mothers exempt from fasting if their infant can also accept formula?

In Section B we deal with persons who are not exempt from fasting, but who are nevertheless permitted to take medication on a fast day (except Yom Kippur). For example, is a person suffering from a mild headache permitted to swallow two Tylenol tablets with a small amount of water?

In Section C we discuss who (besides life-threatened individuals) is exempt from fasting and who may take medication on Yom Kippur. In this section, we also set forth instructions for eating “shiurim.” For example, although a pregnant woman is generally not exempt from fasting, nevertheless, if dehydration can put her at risk for early delivery, she will be exempt.

In Section D we discuss taking medication on Yom Kippur. For example, is a person suffering from a debilitating migraine headache permitted to swallow two Tylenol tablets with a small amount of water? 4

A. Fast Days Midirabonon

The Shulchan Aruch states5 that every Jew is required to fast on the four fast days that were decreed upon k’lal Yisroel by the Prophets:6 Tisha B’Av, Seventeenth of Tammuz, Tzom Gedalia, and the Tenth of Teves.*

Chazal instituted an additional obligation7 for all of k’lal Yisroel to fast on the 13th of Adar, – Ta’anis Esther. (The requirement to fast on Ta’anis Esther is less stringent than the requirement to fast on the other fast days, as will be discussed in Section B of this chapter.)

The Shulchan Aruch further states that no healthy able-bodied person should free himself or herself from the obligation to fast.8

*The Rambam9 focuses us on the objective of these four fast days. It’s not about remembering these catastrophically tragic days in Jewish history. It’s about stimulating a wakeup call for teshuva. Why did Hashem annihilate so many men, women, and children and rip us out of our nation to disperse us in golus? Why is He keeping us in golus now? We should not just observe the fast and shrug off the entire objective, but rather use the fast to bring us to self-introspection and teshuva. 10

Note: Even persons who are not exempt from fasting are nevertheless permitted – in most instances – to swallow medication, as discussed in Section B. Taking medication on Yom Kippur will be discussed in Section D.

1. Persons who are Exempt from Fasting

a. Ill, Weak

b. Pregnant

c. After Childbirth

d. Nursing

Note: The information and guidelines discussed in this section is intended to give the reader an understanding and overview of the criteria for being exempt from fasting. In most instances, the permissibility of not fasting on any of the Rabbinic fast days requires the judgement and experience of a halachic authority who should be consulted to determine whether the person is or is not in the category of being exempt from fasting.11

Persons who are in fact exempt from fasting are halachically permitted to eat and drink normally without limiting* their intake of food or drink. Nevertheless, they should eat in private,12 and should forego pleasurable delicacies13 (e.g., meat, wine, ice cream, chocolates, etc.). Furthermore, the minhag is to scale down one’s eating so as to express their solidarity and join with the pain and sorrow of the tzibur that is fasting.14 **

*Shiurim – Unlike Yom Kippur, persons exempt from fasting are not required to eat “shiurim” (minimal amount of food and drink, as explained in Section C.2 of this chapter). Since fasting on the four fast days is a prohibition enacted by Chazal, Chazal saw fit to exempt those individuals entirely.15 However, if one is not ill now, but is at risk for becoming ill (e.g., persons weakened by pregnancy or old age, or persons in the proximity of infectious disease, who are at significant risk for becoming ill if they fast), he may be instructed by his Rav to eat “shiurim”16 in order to prevent becoming ill.17 Persons eating “shiurim” are considered to be fasting on these four fast days.

**Once they are exempt, they remain exempt from fasting for the rest of the day even if they are no longer sick later during the fast day. Similarly, one whose illness requires him to drink in order to stay hydrated, but doesn’t require him to eat, is nevertheless exempt from drinking and eating. In such situations, it is also appropriate to scale down one’s eating in order to express his solidarity and join with the pain and sorrow of the tzibur that is fasting.18

A. Ill, Weak

Chazal specifically exempted from fasting persons who are bedridden, or weak, or ill.19

The Poskim give the following guideline for exempting a person who is ill: one whose entire body is weak from fasting – weaker from fasting than the average person who is fasting – is eligible to be exempt from fasting on the four fast days.20

Thus, a person who is bedridden (e.g. in bed with a severe cold or flu) is unquestionably permitted to eat and drink on the fast day (except Yom Kippur). It is improper for such a person to fast.21

Persons who are vomiting or have diarrhea are at risk of becoming dehydrated which can be dangerous. Such persons, even if they are not bedridden, should drink and stay hydrated even on Tisha B’Av. 22

Persons suffering from a localized pain such as a headache23 * or joint pain, are generally not exempt from fasting. Nevertheless, they are permitted to swallow medication as discussed in Section B of this chapter.

*Migraine Headache – If one is incapacitated from the pain (e.g., severe migraine), or it is accompanied by fever, he may eat.

B. Healthy Pregnant Women

Healthy pregnant women who are not experiencing pain (other than the normal discomfort that everyone feels when fasting) are technically exempt from fasting on 17th of Tammuz, Tzom Gedalia, and the 10th of Teves (but not Tisha B’Av24). Nevertheless, the minhag was that pregnant woman who felt healthy would even fast on the 17th of Tamuz, Tzom Gedalia, and the 10th of Teves.25 *

*The requirement of pregnant women to fast on Ta’anis Esther is even more lenient – see part 2 of this section.

Even women whose minhag it is not to fast on a rabbinic fast day should, nevertheless fast the entire fast day of Tisha B’Av.26 **

**When Tisha B’Av falls on Shabbos and is postponed until Sunday (Tisha B’Av nidcha), pregnant women with even minor illness or discomfort are exempt from fasting. Right after Shabbos, they should recite havdolah on chamar medina (popular choshuv beverage such as coffee or beer that may be used as a substitute for wine at havdolah) and may eat and drink. If they feel perfectly fine, they should wait until Sunday morning to recite havdolah and break their fast.27

C. High-Risk Pregnancy

Women with high-risk pregnancies28 (e.g., diabetic, anemic, high blood pressure, carrying twins, etc.),29 or those at risk for early labor or miscarriage, in which case there is a potential life-threatening risk to mother or fetus are exempt from fasting even on Tisha B’Av and may drink or eat* regularly.** A woman with a history of preterm labor (contractions prior to 38 weeks) should drink regularly on rabbinic fast days, however, on Tisha B’Av she should drink with shiurim in order to prevent dehydration and possible premature labor.30

*Even women who are exempt from fasting rarely need to eat solids, as consuming liquids (e.g., Powerade, grape juice, chicken soup, etc.) will almost always take care of the problem.

**A woman in the early stages of IVF or ICSI assisted pregnancies (or the like) should consult with her doctor and with a competent halachic authority to determine if she should drink or eat on Tisha B’Av in order to prevent miscarriage of the fetus.31

D. Pregnant Women experiencing Symptoms

Pregnant women who are experiencing excessive weakness,32 pain,33 dizziness,34 vomiting,35 or lack of sufficient hydration36 should lie down and rest and drink or eat as necessary.*

If she is experiencing a low-grade fever (i.e., 100.5 degrees or above), abdominal pain, leakage, or discharge with a bad odor, she should call her doctor immediately and drink or eat regularly.37

Furthermore, even on Tisha B’Av, the Poskim exempt pregnant women (even women in their ninth month), if there is any reasonable risk that fasting might cause premature delivery.38

This applies to all rabbinic fast days, even Tisha B’Av (but not to Yom Kippur; for pregnant women on Yom Kippur, see section C.1.b).

*First Forty Days of Pregnancy – Even women who are in the first forty days of pregnancy, if they are in pain39 or feel weak,40 or are vomiting, are exempt from fasting on all the fast days including Tisha B’Av.41 Nevertheless, if they are just experiencing nausea or other minor discomforts, but are otherwise healthy, they should fast on Tisha B’Av.

E. Pregnant Women with Premature Contractions

When a pregnant woman becomes dehydrated from fasting on Tisha B’Av, she is at risk of inducing early labor and childbirth. If she has not yet reached the expected time for delivery (before the 38th week of pregnancy) and begins to feel the possible onset of labor (one or two very strong contractions or has four or more contractions within the span of an hour), she should drink 2 or 3 eight-ounce glasses of water or grape juice or Powerade (no shiurim) in an effort to stop the onset of labor. Should the contractions stop, she should rest and continue drinking regularly, even without shiurim. 42

If she has reached her time for delivery (38th week), when mother and infant are no longer in danger of early childbirth, there is no need for her to break her fast should contractions begin. Nevertheless, once she starts active labor (strong contractions at regular intervals, typically every five minutes, or when the water breaks) she is permitted to eat and drink normally in order to have strength for the delivery.43 *

*If she is already in the hospital when active labor starts, she will typically be on IV fluids in which case additional drinking is unnecessary. Furthermore, the medical team will typically restrict her from food and drink until after the delivery.

F. After Childbirth

A woman after childbirth* is exempt from fasting on all rabbinic fast days** including Tisha B’Av.*** This exemption extends until thirty days after the birth,44 even if she is not nursing.45

*A woman who suffered a miscarriage46 after forty or more days of pregnancy47 is given the same exemptions from fasting as one who delivered a viable baby.

**Regarding exemption from fasting after childbirth before or on Yom Kippur see Section C of this chapter.

***If she feels well enough and wishes to fast on Tisha B’Av, she may do so, but only after seven days from the birth. However, if she started fasting but became weak during the fast, she should immediately break her fast.48

After thirty days, women who are no longer exempt due to childbirth may, nevertheless, still be exempt from fasting if they are nursing49 (see paragraph g of this section) or if they remain weak and are not fully recovered from the delivery50 (see paragraph a of this section).

G. Nursing

Nursing mothers51 whose fasting may decrease52 the amount of milk available for their baby are exempt from fasting (even if they are otherwise healthy and able to fast).

Even if the baby is able to drink from a bottle and eat solid food, nevertheless, if the baby’s primary diet includes mother’s milk and that part of the baby’s diet will be decreased by the fast, the mother is exempt from fasting.53 *

Nursing mothers who are not experiencing weakness or pain (i.e., not discomforted more than other people who are fasting) and who don’t have a problem of decreasing their milk needed for their baby – should fast on Tisha B’Av (but not on Tisha B’Av nidcha, i.e., Tisha B’Av that falls on Shabbos and is postponed until Sunday).54

* However, if the mother would normally give the baby a bottle on occasion (e.g., going to a wedding or in the middle of the night) and the baby can suffice with one bottle (e.g., near the end of Tisha B’Av), then she should give the baby a bottle rather than break her fast. 55

2. Ta’anis Esther

The requirement to fast on Ta’anis Esther56 is less stringent than the requirement to fast on the other fast days.57 Pregnant women and nursing mothers are generally exempt even if they are not experiencing pain or weakness.58

Persons suffering from painful ailments are generally exempt even if they are not experiencing pain or weakness in their entire body.59

One who can fast should make every effort to fast on Ta’anis Esther as it is a propitious day to be granted success and protection through teshuva and fasting.* Nevertheless, if fasting on Ta’anis Esther is physically difficult, he may rely on the less stringent eligibility to be exempt. However, it is appropriate to consult a Rav to determine whether his specific situation is in fact eligible to be exempt from the fast.60

*It is called Ta’anis Esther to focus us on the fact that when a person is in danger and fasts and repents and turns to Hashem with all his heart, as was the case in the time of Esther, Hashem sees and listens to their pleas and saves them. 61

B. Taking Medication on a Fast Day (Except Yom Kippur)

1. Bitter Tasting Pills

Persons who are not exempt from fasting are nevertheless permitted to swallow bitter tasting medicine on the four fast days (i.e., even on Tisha B’Av). This is because swallowing an inedible item such as a bitter pill is not classified as “eating” on a fast day. In addition, the fact that the requirement to fast on these days is not d’oraisa, and the size of the pill swallowed is less than a shiur, augments this leniency.62

According to many Poskim,63 a person who is otherwise healthy but is suffering from an ailment (such as a mild headache, arthritis pain, etc.) may swallow a bitter tasting pill on these fast days even though his ailment is not incapacitating. *

*Due to the severity of Tisha B’Av, some Poskim64 suggest that a person who is otherwise healthy and not incapacitated should not even swallow bitter tasting pills on Tisha B’Av.

Swallowing a caffeine pill to prevent or address caffeine withdrawal symptoms (e.g., headache or lethargy) is permitted on a fast day, even on Tisha B’Av.65 Swallowing bitter tasting hormone pills to regulate the menstrual cycle or to promote fertility is also permitted on these fast days.66 Vitamins and food supplements should preferably be taken before or after the fast and not on the fast day.67

2. Pleasant Tasting Pill

It is questionable if the permissibility of swallowing a pill on a fast day applies to swallowing medicine which is pleasant tasting, such as chewable tablets or sweetened liquids.68 *

*The Poskim give the following advice when a bitter tasting alternative medicine is not available. He should mix a bitter tasting substance into the medicine and thereby convert it into a bitter tasting medicine, in which case it would be permitted to swallow on the fast day.69 Some Poskim rule that it is sufficient to add concentrated tea, coffee granules, baking soda, or the like, in order to render the small amount of liquid to be bitter tasting. 70 Alternatively, if a sweet-coated tablet is the only tablet available to him for his minor ailment, it is preferable to wrap it in a small piece of tissue and swallow it that way.71 Suggested instructions for wrapping a capsule or tablet are as follows: wrap a small piece of tissue around the tablet or capsule, just enough to cover it. Then wet the fingers in water and gently moisten the wrapped capsule. In this manner, the tissue will adhere to the tablet or capsule and it will be more easily swallowed. If the tablet is too large to swallow, break it in half and wrap the individual pieces.

3. Cannot Swallow Pill without Water

If one needs to swallow a pill (i.e., he cannot wait until after the fast), but cannot swallow it without water, he is permitted, according to some Poskim, to take the pill with less than an ounce of water. This leniency applies to the four fast days including Tisha B’Av, but not to Yom Kippur.72

Other Poskim are of the opinion that an otherwise healthy person who needs some water to swallow a pill for a minor ailment, should add something bitter* to the water in order to render the water inedible.73

*Some Poskim rule that it is sufficient to add concentrated tea, coffee granules, baking soda or the like, in order to render the small amount of water inedible. 74

Note: One who swallows a bitter pill without water on Tisha B’Av or on one of the other fast days is still considered as fasting. Even one who swallows a pill with the aid of a little bit of water (less than an ounce) is still considered fasting (i.e., he can daven as the shliach tzibur, can have an aliya, etc.).75

4. Suppository, Patch

Persons who have difficulty swallowing a pill without a sufficient amount of water, or have difficulty swallowing a pill wrapped with a small piece of tissue, may find it easier to take the medication in the form of a suppository or patch. Whereas taking it that way on Yom Kippur is only permitted for patients who are considered incapacitated (due to the restriction of taking medicine on Shabbos and Yomtov), on the other fast days it may be taken by anyone.76

For example, on any fast day (other than Yom Kippur) one who is otherwise healthy but is experiencing caffeine withdrawal symptoms (and cannot swallow a caffeine pill without an ample amount of water) is permitted to take caffeine suppositories, no matter how minor the symptoms are.77 One who is experiencing mild arthritis discomfort is permitted to apply a patch infusing topical pain medication.

C. Yom Kippur

Introduction: Prohibition of Eating on Yom Kippur

Eating on Yom Kippur an amount of food the size of a “koseves” (slightly more than a k’zayis)78 or drinking an amount of drink the size of “m’lo lugmov (i.e., if a person were to fill his mouth to the maximum amount of liquid that fits in his mouth, the amount equal to half of that liquid is a “m’lo lugmov”,79 typically between 1 and 2 ounces80) is prohibited by the Torah - issur d’oraisa. 81

Eating or drinking an amount less than the shiur, even a minuscule amount, is still prohibited by the Torah, but with a lesser prohibition.82

Nevertheless, persons who are weak or ill (or who may miscarry, or are within the first three days of childbirth), whose fasting may possibly exacerbate their condition (or the condition of their baby) to the extent that it becomes life-threatening, are exempt from fasting (as discussed in the following section C.1).

1. Persons Exempt from Fasting on Yom Kippur

In this section we discuss persons who are exempt from fasting on Yom Kippur in the following format:

a. Seriously Weak or Ill

b. Pregnant

c. Childbirth

d. Miscarriage

e. Nursing

f. Fainting

g. Kidney Stones

h. Diabetes

i. Cancer

Note: In some instances persons who are exempt from fasting will be instructed to eat or drink “shiurim,” in order to provide them with needed sustenance and hydration while at the same time downgrading the prohibition of eating and drinking to a less severe issur.83 Instructions for eating “shiurim” are discussed in detail in Section D.2 (following this section).

Because of the complexity and severity of the medical and halachic issues involved, one should not take it upon oneself to decide whether or not one should eat on Yom Kippur. Both the person who errs in being unnecessarily lenient84 and the person who errs in being unnecessarily stringent85 may violate serious Torah prohibitions. Rather, the decision to fast or to eat “shiurim” or to eat normally should be determined by a halachic authority86 knowledgeable in the medical ramifications of the specific case.87

Persons who are not exempt from fasting on Yom Kippur are still, in many instances, eligible to take medication on Yom Kippur. This is discussed in in the last part of this section (D.3).

a. Seriously Weak or Ill

Persons who are seriously weak or ill* whose doctor advises that fasting may possibly exacerbate their condition – to the extent that it may become life-threatening – are exempt from fasting.88 This does not mean that the patient is at risk to possibly die now as a result of fasting. Rather, it means that by not eating he may worsen his condition to the extent that it may shorten the time he has to live.89

*E.g., serious cases of congestive heart failure, excessively high or excessively low blood pressure,90 lung disease (e.g., COPD), mononucleosis,91 cancer patient undergoing chemotherapy,92 post-operative patients, etc.

Optimally, one should consult with a doctor who is familiar with his case and who himself fasts on Yom Kippur.93 However, if an observant Jewish doctor is not an option, one may rely on the assessment of a non-Jewish doctor or non-observant Jewish doctor (even though the doctor doesn’t understand the seriousness of fasting on Yom Kippur).94

Even if the patient is advised that he can circumvent having to drink on Yom Kippur by receiving intravenous (IV) hydration which can be inserted before Yom Kippur, he should nevertheless choose to drink regularly rather than through IV fluids.95 He should drink shiurim of fluids (which in almost all cases will satisfy the need for hydration).

b. Pregnant

All pregnant women are required to fast on Yom Kippur96 except those with high risk pregnancies97 (e.g., diabetic, anemic, high blood pressure, etc.), or those at risk for early labor or miscarriage, in which case there is a potential life-threatening risk to mother or fetus.*

*A person may override Shabbos prohibitions in order to save the life of a prematurely born infant,98 an unborn fetus, or even an embryo99 (a fetus during the first eight weeks of pregnancy is called an embryo). Similarly, a pregnant woman may override the prohibition of eating on Yom Kippur in order to save a fetus or even an embryo, even if she herself is not at risk.

A woman in the early stages of IVF or ICSI assisted pregnancies (or the like) should consult with her doctor and with a competent halachic authority to determine if she should drink shiurim on Yom Kippur in order to prevent miscarriage of the fetus.100

The determination of whether or not the risk is serious enough to be eligible for an exemption from fasting should only be made in conjunction with one’s doctor and a competent halachic authority.101

Pregnant women who are experiencing vomiting or excessive lightheadedness or dizziness or significant bleeding102 should lie down and drink shiurim right away. If her symptoms persist, she should call her doctor.

Pregnant women who are experiencing abdominal pain, or a low-grade fever (i.e., 100.5° or above), or leakage, or a discharge with a bad odor, should call their doctor and drink without shiurim.103

When a pregnant woman becomes dehydrated from fasting on Yom Kippur, she is at risk of inducing early labor and childbirth. If she begins to feel contractions, she can avoid or limit the risk of dehydration by staying in bed. It is preferable that she stay in bed rather than go to shul* and thereby place herself in a situation where she will need to eat.104

*If the husband’s assistance at home is needed to facilitate her staying in bed in order to avoid her need to eat or drink, it is preferable for the husband to stay home and assist her rather than going to shul. 105

If she has not yet reached the expected time for delivery (before the 38th week of pregnancy) and begins to feel the possible onset of labor (one or two very strong contractions, or has four or more contractions within the span of an hour), she should drink 2 or 3 eight-ounce glasses of water or grape juice or Powerade (no shiurim) in an effort to stop the onset of labor. Should the contractions stop, she should rest and continue drinking – but with shiurim.106

If she has reached her time for delivery (38th week), when mother and infant are no longer in danger of early childbirth, there is no need for her to break her fast should contractions begin. Nevertheless, once she starts active labor (strong contractions at regular intervals, typically every five minutes, or when the water breaks) she is permitted to eat and drink normally in order to have strength for the delivery. 107 *

c. Miscarriage

A miscarriage has the same halachic status as a viable childbirth with regard to being exempt from fasting on Yom Kippur.108

Many Poskim are of the opinion that the exemption from fasting also applies to a woman who miscarried early in the pregnancy, provided that the embryo is past the fortieth day of its development.109 If the miscarriage occurs prior to forty days she is not exempt from fasting.

d. Childbirth

During childbirth110 – from the start of active labor111 until 72 hours after the birth112 – the expecting mother is exempt from fasting. Even if she does not ask for food nor does the doctor direct her to eat, nevertheless, after delivery she should be encouraged to eat and drink in order to recover from the loss of blood and internal stress of childbirth.113

During the first 72 hours, if she insists that she does not need to eat or drink on Yom Kippur, we require her to at least eat and drink shiurim.114

During the next 96 hours if the doctor (or if she herself) says she needs to eat or drink, she is permitted to eat shiurim.115

e. Nursing

Nursing mothers are required to fast on Yom Kippur.116 However, if there is a reasonable risk that her fasting will decrease the amount of milk needed for the baby, and the baby’s primary sustenance is mother’s milk, she will typically be directed to drink shiurim.117

Halachic and medical sources emphasize the importance of mother’s milk (as opposed to formula)118 for at least the first six months after birth119 in order to promote the health, growth, and development of the child. Thus, the Poskim permit the mother to drink shiurim on Yom Kippur to enable nursing when the baby’s primary sustenance, even if the infant can be fed formula.*

Beyond the first six months, the use of mother’s milk as opposed to formula is not as essential. Thus, drinking (even by way of shiurim) to enhance production of mother’s milk is generally prohibited once the infant is older than six months and tolerating other foods or formula.

* However, if the mother would normally give the baby a bottle on occasion (e.g., going to a wedding or in the middle of the night) and the baby can suffice with one bottle (e.g., near the end of Yom Kippur), then she should give the baby a bottle rather than break her fast. 120

f. Fainting

If a person faints for unknown reasons – and loses consciousness but recovers within seconds – he should be given an ample amount to drink (no shiurim).121 As soon as possible, he should be medically assessed to rule out any serious cause (e.g., arrhythmia, stroke, etc.).

Note: If a person is about to faint,122 ideally have him lie flat on his back and elevate his legs. If this is impractical (e.g., he is sitting on a chair) have him slowly bend forward and place his head between his knees. When a person faints it is very important to check his breathing and pulse. If he is not breathing, he needs IMMEDIATE resuscitation and medical attention. Hatzolah or EMS should be called immediately. Seconds count!

g. Kidney Stones

A severe kidney stone attack is treated as possibly life-threatening due to the risk of kidney infection.123 A person who has kidney stones and is directed to drink plenty of fluids in order to reduce the risk of an attack, should do so – but only with shiurim.124 *

*Some Poskim125 recommend that one should make the water bitter tasting (i.e., add concentrated tea, coffee granules, baking soda, or the like). 126 However, if the patient will not be able to tolerate the bitter liquid, he should drink regular water with shiurim.

h. Diabetes

An insulin-dependent diabetic (type-1 diabetics and some type-2 diabetics) can be at life-threatening risk from fasting due to severe hypoglycemia or hyperglycemia. Most insulin-dependent diabetics are not permitted to fast.127 *

*In some less severe cases, if the doctor permits the patient to eat with shiurim he should do so. In a minority of cases of insulin dependent diabetes, the doctor will permit the patient to fast provided that he carefully monitors his blood sugar numerous times on Yom Kippur. In such a situation, if the patient is attached to a CGM and must activate an electronic reader (e.g., press a button) he must do so with a shinui. If the patient manually tests his blood by pricking his finger with a lancing device, he should ask a non-Jew to draw the blood. If a non-Jew is not available, he is permitted to draw the blood himself, but only by way of shinui (e.g., squeeze the release trigger of the lancing device with his teeth or with the back of his finger, squeeze the blood out of his finger by pressing it against a tabletop, insert the strip into the reader without turning it on, and then give the final push on the monitor device with an elbow or back of the hand). If he cannot extract his blood by way of shinui, he should eat rather than transgress the Torah prohibition of drawing blood on Yom Tov.128

A patient with diabetes who does not require the use of insulin is typically required to fast (as he is not at risk for severe hyperglycemia or hypoglycemia), unless his doctor directed him otherwise.

i. Cancer

Patients undergoing treatment for cancer are generally debilitated and have a compromised immune system, either due to their illness or due to the treatment. Therefore, it is often important for them to maintain adequate nutrition and hydration in order to prevent life-threatening risks, especially infection. A patient with cancer must consult with his doctor and with a competent halachic authority whether he must eat regularly, or is stable enough to eat shiurim or is even able to fast on Yom Kippur.129

2. Instructions for Eating or Drinking “Shiurim”

a. Shiur for Solid Food

b. Shiur for Liquid

c. Brocha

The term shiurim (used in the context of fasting) means that the patient is given small, measured amounts of food or drink waiting l’chatchilla130 nine minutes between each installment of food131 and each installment of drink.132 * If it is difficult to wait nine minutes one may rely on a more lenient ruling of the Poskim, as will be discussed.

Shiurim is only used as an option in cases where the patient’s condition will definitely not be compromised by eating or drinking in installments. In such cases, by eating shiurim we effectively downgrade the prohibition of eating and drinking from a severe issur d’oraisa to a less severe issur d’oraisa.133

*If the doctor or the choleh have any doubt at all as to whether eating shiurim will be detrimental to the patient’s condition, he should eat as if it were a regular day. 134

Note: If the patient is directed to eat normally in the late morning or afternoon when he begins to feel weak, it is preferable to eat or drink shiurim even before he feels weak, in order to avoid the need to eat a full shiur later on.135

If the patient can remain in bed without requiring shiurim, but the exertion of going to shul will cause the need to drink with shiurim (even if only one time) he should stay in bed. 136

a. Shiur for Solid Food

The amount of solid food* equal to a shiur is slightly more than a k’zayis137 (slightly more than the size of a half of a hardboiled large egg).138

*Yogurt, leben, and the like (being thicker than beverages) are considered solids with regard to the shiur. 139 (A one-ounce whiskey shot glass filled (up to the one-ounce mark) with yogurt equals a k’zayis.)

Before Yom Kippur one should determine the size of the portions that he will be eating in installments.140 One should eat as close as possible to the maximum amount of the shiur and should not try to be machmir by eating less.141 **

**For example, 6 Tam Tam crackers or 4/10 of a matzoh equals a k’zayis, almost the shiur of one installment. If he plans to eat crackers or matzoh, he should know the shiur and not try to eat only 3 or 4 crackers just to be sure.

L’chatchilla, one should wait nine minutes between each installment of solid food.142 If it is very uncomfortable for the patient to wait nine minutes between installments, he is permitted to reduce the waiting time between installments to five minutes143 and if necessary, even less (according to the directive of a competent halachic authority).144

b. Shiur for Liquid

The shiur of liquid is “m’lo lugmov, a mouthful. The Shulchan Aruch defines this shiur as an amount equal to half of the liquid that fits into the patient’s own mouth.145 This is determined by filling one’s mouth – before Yom Kippur146 – with the maximum amount of liquid that it can hold, then expelling the liquid into a measuring cup. Half of the patient’s full mouthful is the correct liquid shiur for him147 – typically between ¾ of an ounce and 1½ ounces.148

Persons who are directed to drink shiurim are not limited to water. Therefore, many Rabbonim recommend that their incremental drink should be a more satiating liquid such as clear soup* or grape juice.149

*Clear chicken soups, clear broth, and other non-viscous soups, even though they are eaten with a spoon, nevertheless have the shiur of liquids. 150

L’chatchilla one should wait five minutes between each installment of drink.151 If a five-minute wait makes it difficult for him to obtain the hydration he requires, he may reduce the waiting time to three minutes between each installment. If one’s condition requires that he drinks lots of fluids (e.g., certain forms of kidney disease,152 severe diarrhea, etc.), he may, upon the direction of a competent halachic authority, reduce the waiting time to 30 seconds between installments.153

Note: A shiur of solid food and a shiur of drink can be eaten at the same time.154 For example, at 9:00am the patient can eat a half of a hard-boiled egg, and at the same time drink an ounce of juice, then at 9:09 eat the other half of egg and drink another ounce of juice. There is no waiting required between the food (solid) and the drink.

C. Brocha

One who is permitted to eat shiurim on Yom Kippur is required to recite a brocha rishona for the food that he must eat.155 The brocha rishona will be valid for all subsequent small portions of food or drink until he finishes156 (provided he did not exit the building or change locations since reciting the brocha).157

One who eats “shiurim” will not be eligible to recite a brocha achrona because by eating in small installments he will usually be eating less than a shiur necessary for a brocha achrona.158

Patients who are directed to eat “shiurim,” if they eat bread, should not wash (n’tilas yodayim).159

However, patients who are directed to eat normally, if they eat bread, should wash n’tilas yodayim as they would on a regular day. 160 If they eat a k’zayis of bread within three or four minutes they are required to recite bircas hamozon.161 According to many Poskim, yaaleh v’yavo should be added to bircas hamozon.162 The phrase yom hakippurim hazeh is inserted in yaaleh v’yavo of bentching. If Yom Kippur falls on Shabbos, r’tzei should also be added.163

d. No Kiddush

There is a halachic uncertainty with regard to the requirement of kiddush on Yom Kippur, even for Yom Kippur which falls on Shabbos.* Therefore, one who is directed to eat may not recite kiddush (even if he wishes to be machmir). This is because according to the opinion that kiddush is not required, it would be a brocha l’vatolah.164

*Although we do not recite kiddush, nevertheless, the Poskim recommend that everyone (not only sick persons) should preferably be yotzeh the mitzvah of sanctifying Shabbos on Shabbos Yom Kippur. Thus, when one recites the words “mekadesh haShabbos” in Sh’mona Esrei, he should have specific intention to also be yotzeh the mitzvah of remembering Shabbos to sanctify it.165

Section D: Taking Medication on Yom Kippur

Patients with life-threatening conditions* are unequivocally permitted to take their medications on Yom Kippur.

*A person need not be confined to the hospital, or even confined to a bed in order to be considered life-threatened. For example, most persons taking cardiac medications, antibiotics for internal infection, high blood pressure medications, anti-rejection medications after a transplant, diabetic medications, and chemotherapy medications for cancer, are all considered life-threatened without their medicine (even when they are not confined to a bed).166

In many instances, even patients with much less severe conditions are nevertheless permitted to take medications on Yom Kippur – as about to be explained.

In order to determine when one who is not life-threatened may take medications on Yom Kippur, we must consider that besides the issur d’oraisa (Torah prohibition) of eating and drinking,167 there is an issur d’rabbonon to use any form of medication on (Shabbos, Yom Tov or) Yom Kippur.168

For example, aspirin, acetaminophen, or ibuprofen are all available in rectal suppository form, or in a skin patch form. Insertion of a suppository or applying a skin patch is not a form of eating and is permitted even for minor ailments on any other fast day.169 However, on Yom Kippur one may not take medication for a minor or moderate headache (unless it is so severe as to be incapacitating170)* because there is an issur d’rabbonon of taking medicine on Yom Kippur even if it is not breaking the fast.

*A person whose illness is not life-threatening, but who feels so sick that he stays in bed (e.g., someone with a severe cold or the flu), is considered to be incapacitated.171 Even one whose illness does not force him to stay in bed (e.g., someone with severe diarrhea), but it causes his whole body to hurt, or to feel weak and sluggish, is also considered to be incapacitated.172 Furthermore, when an illness causes a person so much pain or discomfort that he cannot function normally (i.e. he is so “out of commission” that he would stay in bed if that would help him), that person is considered to be incapacitated.173

Nevertheless, a person who is suffering from an incapacitating illness is permitted to apply a skin patch or to insert a suppository – because that is not considered eating on Yom Kippur,174 nor is the incapacitated patient subject to the issur d’rabbonon of taking medicine.175

1. Swallowing Bitter Pill on Yom Kippur

Furthermore, a person suffering from an incapacitating illness is even permitted to swallow a bitter tasting pill or capsule, because that is considered “not eaten in a normal manner” which is permitted for a sick person even on Yom Kippur.176

2. Swallowing Pill with some Water on Yom Kippur

If one cannot swallow a pill without liquid, he may add a few drops of soap* to a spoonful of water177 or crush and dissolve part of the bitter pill into a spoonful of water, and use that water to help swallow the pill.178 In either case since the water is no longer fit to drink (and is less than a shiur),179 the prohibition of not drinking on Yom Kippur is reduced to an issur d’rabbonon, which is permitted for the incapacitated patient.**

* I.e., enough to spoil the taste – not so much as to cause nausea.180

3. Inserting Suppository or Applying Patch on Yom Kippur

Although medication that is absorbed into the body is not considered eating on Yom Kippur, nevertheless, one may not apply a medicated suppository or patch unless his illness is incapacitating. *

For example, on any fast day besides Yom Kippur, one who is experiencing caffeine withdrawal symptoms is permitted to take caffeine suppositories, no matter how minor the symptoms are.182 On Yom Kippur, a suppository may be inserted only in specific cases where caffeine is required to treat an incapacitating condition such as a severe migraine headache, or one who is experiencing weakness and discomfort in his whole body.183

אמנם לענין ויטמינים סברי כמה מורי הוראה זמנינו שכן שייך "אחשביה" שהרי אוכלם כתחליפי מזון, ויש סוברים שגם בויטמינים לא שייך "אחשביה" כמו בככדורי רפואה. לכן כתבנו שטוב שלא לקחתם תוך התענית, ובמקום צורך גדול יעשה שאילת חכם.

הנה בטור (סי' תרי"ב) מביא דעת הראבי"ה שהאוכל דבר שאינו ראוי לאכול אינו אסור אפי' מדרבן, ובב"י שם תמה למה לא הביא הטור דעת הרמב"ם שסובר שיש עכ"פ איסור דרבנן. ותירץ דאפ"ל שלא כתב הרבאי"ה שפטור לגמרי אלא בדבר שהוא פחות מכשיעור, עוד תירץ שלא התיר הראבי"ה אלא בדבר שאינו ראוי לאכילה כלל, ואולי שגם הרמב"ם מודה לזה, עכת"ד. ומבואר מדברי המ"ב (שם ס"ק ט"ו) והשעה"צ (שם אות י"ז) דעל אכילת דבר שאינו ראויה לאכילה אכן יש בו שיעור אכילה ביוה"כ עובר איסור דרבנן, אבל על אכילת חצי שיעור מדבר שאינו ראוי לאכילה אין בזה אפי' אסור דרבנן מעיקר הדין רק יש לזהר לכתחילה.

היוצא לנו שחולה אפי' אין בו סכנה מותר לבלוע כדור תרופה מר, שהוא פחות מכשיעור וגם אינו ראוי לאכילה. וגם אין בו איסור רפואה ביו"ט שהרי לא גזרו לחולה שאב"ס (ראה הע' הקודמת).

ולהלכה למעשה – כן פסק הגר"מ פיינשטיין זצ"ל באג"מ ח"ג סי' צ"א להתיר ליקח "הפילין" (pills) בלא מים לצורך חולה שאב"ס ביוה"כ. וכן פסק הגרש”ז אויערבאך זצ”ל (שולחן שלמה ערכי רפואה ח"ב עמ' קצ"ב) התיר לחולה שאב"ס לבלוע תרופות ביוה"כ ללא מים. ויותר מזה בשבט הלוי חלק י' סי' פ"ט צידד להתיר לאשה לקחת כדורים ביוה"כ לסדר וסתה אף שאינה חולה אלא לוקחה לשם מצוה, ומחלק בין דבר שאינו ראוי לאכילה, אבל אך הוא אוכל, שאסור לכתחילה, ובין כדורים שהם כעץ בעלמא שאף לכתחילה מותר. וכן שמענו מהגרי"א דינר שליט"א שכך שמע מבעל שבט הלוי זצ"ל הלכה למעשה להתיר לקחת כדורים מרים ביוה"כ לחולה מכיון שהם כץ בעלמא. וכן פסק הגר"נ קרליץ זצ"ל (חוט שני חלק יוה"כ פ"ו אות ג').

[181] בשבט הלוי ח"י סי' פ"ט נשאל אם אשה הצריכה לקחת כדור בכל יום כדי לסדר את וסתה, האם מותר לקחת הכדור ביום הכיפורים, והשיב שאפשר לצרף דעת הראבי"ה מובא בב"י סוף סי' תרי"ב דהא דחצי שיעור אסור לכתחלה הוא דוקא בדבר הראוי לאכילה, אבל בדבר שאינו ראוי לאכילה גם לכתחלה מותר. ואף שאנו נקטינן שלא כראבי"ה, אפשר לצרף דעת ישועת יעקב שם שמצרף דעת הראבי"ה ועוד אפשר לצרף דעת הט"ז שם ס"ק ו' דדבר שאינו ראוי לאכילה כלל כעץ בעלמא מותר לבלוע לכתחילה, וסיים שם שבט הלוי בזה"ל: אם הוא גדר מצוה, וגם קרוב שאין בו שום שייכות לטעם, ונלקח לא לסבת אכילה, אם מתירים כזה אין להזניח, עכ"ל.
